1. Acceptance of Terms

Welcome to FoodTrips.

These Terms of Service (“Terms”) govern your access to and use of the FoodTrips mobile application, website, content, services, and related features (collectively, the “Services”).

By accessing, downloading, registering for, or using FoodTrips, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

2. About FoodTrips

FoodTrips is a food and travel discovery platform designed to help users explore gastronomy, culinary culture, local specialties, food experiences, restaurants, producers, markets, and related food destinations.

FoodTrips is intended for informational and discovery purposes only.

Some text and images displayed within FoodTrips are generated or assisted by artificial intelligence (AI). Section 13 explains what this means and how it affects the content you see.

FoodTrips does not guarantee the availability, quality, pricing, safety, accuracy, or continued operation of any third-party business, restaurant, producer, experience, or location featured on the platform.

3. Eligibility

You must be at least 18 years old to create an account or use FoodTrips.

By using the Services, you represent and warrant that:

  • You are at least 18 years old
  • You have legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

4. User Accounts

To access certain features, users may be required to create an account.

Users are responsible for:

  • Maintaining the confidentiality of login credentials
  • Restricting access to their account
  • All activity occurring under their account

You agree to provide accurate and complete information.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

5. User Content

Users may submit content including:

  • Reviews
  • Ratings
  • Lists
  • Images
  • Comments
  • Profile information
  • Other user-generated content

You retain ownership of the content you submit.

However, by uploading or submitting content, you grant FoodTrips a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • Host
  • Store
  • Reproduce
  • Display
  • Distribute
  • Adapt
  • Promote

such content in connection with operating and improving the Services.

6. Content Standards

Users may not submit content that:

  • Is false or misleading
  • Is defamatory
  • Is abusive or harassing
  • Promotes hate or discrimination
  • Infringes intellectual property rights
  • Contains illegal material
  • Contains spam or commercial advertising
  • Violates applicable laws
  • Is generated or manipulated by AI in a way intended to deceive other users (for example, AI-generated reviews presented as genuine personal experiences, or manipulated images presented as authentic photographs)

FoodTrips reserves the right to remove content at its sole discretion.

7. Reviews and Ratings

Users are responsible for the accuracy of reviews and ratings they submit.

Reviews represent individual opinions and do not represent the views of FoodTrips.

FoodTrips does not independently verify the accuracy of user reviews.

We reserve the right to remove reviews that violate these Terms, including reviews that misrepresent AI-generated content as a genuine personal experience.

8. Subscriptions

Certain features of FoodTrips require a paid subscription.

Subscription details, pricing, and available features may change over time.

Current launch pricing:

€10 per year

Pricing may vary by region, currency, taxes, platform fees, or future product changes.

9. Automatic Renewal

Subscriptions automatically renew unless cancelled before the end of the current billing period.

  • Payment will be charged through your Apple App Store or Google Play account
  • Renewal charges will occur automatically unless auto-renewal is disabled through your device settings
  • Users are responsible for managing their subscriptions

10. Cancellation

Users may cancel their subscription at any time through the Apple App Store or Google Play subscription settings.

  • Cancellation prevents future renewal charges
  • Cancellation does not generate refunds except where required by applicable law or platform policies

11. Subscription Expiration

If a subscription expires:

  • Access to premium features may be suspended
  • Access to premium content may be restricted
  • Lists, saved items, reviews, and account information may remain stored
  • Previously stored information may become accessible again upon reactivation of a valid subscription

FoodTrips is not required to permanently retain user content indefinitely.

12. Intellectual Property

The Services and all associated content, including but not limited to:

  • Text
  • Graphics
  • Logos
  • Databases
  • Design
  • Software
  • Images
  • Maps
  • Curated recommendations
  • AI-generated or AI-assisted text and images

are owned by or licensed to FoodTrips and are protected by intellectual property laws, to the fullest extent such content is eligible for protection under applicable law.

Users may not:

  • Copy
  • Reproduce
  • Scrape
  • Republish
  • Resell
  • Redistribute

any substantial portion of the Services without prior written permission.

13. AI-Generated Content

FoodTrips uses artificial intelligence (AI) tools to generate or assist in generating certain text and images displayed within the app, such as descriptions of places, dishes, regional specialties, or illustrative imagery.

13.1 Nature of AI-Generated Content

AI-generated or AI-assisted content is provided for informational and illustrative purposes only. It:

  • May not always reflect real-time, complete, or verified facts about a specific place, dish, or business
  • May include images that are not photographs of the actual location, product, or establishment, unless explicitly stated otherwise
  • Should not be relied upon as a substitute for verified information, professional advice, or direct confirmation with the relevant business

13.2 Transparency

Where required by applicable law, including the EU Artificial Intelligence Act, AI-generated or AI-manipulated content within the app is labeled or otherwise identifiable as such.

13.3 No Liability for AI-Generated Content

To the fullest extent permitted by law, FoodTrips is not liable for:

  • Inaccuracies, errors, or omissions in AI-generated text or images
  • Any discrepancy between AI-generated imagery and the real-world appearance of a place, dish, or business
  • Decisions made or actions taken by users in reliance on AI-generated content

13.4 User-Submitted AI Content

If you submit content to FoodTrips that was itself created or modified using AI tools (for example, an AI-edited photo), you must not present it as an authentic, unaltered depiction of a real experience. See Section 6 (Content Standards).

14. Third-Party Content and Businesses

FoodTrips may contain information regarding:

  • Restaurants
  • Bars
  • Producers
  • Stores
  • Experiences
  • Events
  • Tourism-related businesses

FoodTrips does not own, operate, manage, or control these third-party businesses.

We are not responsible for:

  • Service quality
  • Availability
  • Pricing
  • Reservations
  • Health and safety practices
  • Customer experiences

Users engage with third-party businesses at their own risk.

15. No Warranty

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, FoodTrips disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Availability

We do not guarantee uninterrupted or error-free operation, including with respect to AI-generated content (see Section 13).

16. Limitation of Liability

To the maximum extent permitted by law, FoodTrips, its owner, affiliates, contractors, suppliers, and partners shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Lost profits
  • Loss of data
  • Business interruption
  • Personal dissatisfaction
  • Third-party actions

arising from the use of the Services.

Where liability cannot legally be excluded, liability shall be limited to the amount paid by the user to FoodTrips during the preceding twelve months.

17. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate accounts that:

  • Violate these Terms
  • Abuse the platform
  • Engage in fraudulent activity
  • Harm other users
  • Create legal risk

Termination may occur without prior notice where necessary.

18. Changes to the Services

FoodTrips may:

  • Modify features
  • Add features
  • Remove features
  • Change pricing
  • Change subscription models
  • Discontinue parts of the Services

at any time. We are not obligated to maintain any particular feature indefinitely.

19. Changes to These Terms

We may update these Terms from time to time.

Updated versions become effective upon publication.

Continued use of FoodTrips after changes constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Gipuzkoa, Spain, unless otherwise required by applicable consumer protection laws.
